Idaho is one of the very few states where you can date the change: the corporate practice doctrine was not eroded here, it was withdrawn.
In 2016 the Idaho Board of Medicine rescinded the corporate practice of medicine, and non-physicians may now own medical spas. Idaho is also a full practice authority state, so a nurse practitioner may evaluate, diagnose, prescribe, and own and operate a med spa independently for services within NP scope.
What Idaho actually requires
- A licensed physician as designated medical director to oversee all medical services — Idaho maintains detailed rules on that person’s qualifications and experience, which is unusual for an open-ownership state.
- Verification that your intended director actually meets those qualification rules for the services you offer, rather than simply holding a licence.
- A clear decision between a physician-led model and an NP-led model within NP scope. Both exist here; they are different structures.
- Written protocols and documented delegation, since ownership is doing no compliance work.
- A separate structure for any other state you enter, because an Idaho model built on either open ownership or NP independence does not transfer.
Who may do what in Idaho
| Licence | What they may do |
|---|---|
| MD or DO | Independent; the designated medical director, subject to the qualification rules |
| Nurse practitioner | Full practice authority: may evaluate, diagnose, prescribe, own and operate within NP scope |
| Physician assistant | Within scope, under the applicable arrangement |
| Registered nurse | Within RN scope, under a valid order |
| Non-physician owner | Permitted since the 2016 rescission |
The combination is what to notice. Idaho removed the ownership constraint and kept — in fact specified — qualification requirements for the director. That is the opposite of the usual trade, and it means the person you appoint matters more here than the entity you form.
