Some states leave the ownership question to inference. Arkansas does not.
Only a licensed physician — MD or DO — may own a medical spa in Arkansas, as a direct application of the corporate practice of medicine doctrine. Non-physicians participate through a management services organisation: the medical practice is a physician-owned medical corporation, and the MSO, owned by the non-physician, provides management and administrative services for a fee.
What the MSO may and may not hold
| Function | Where it sits |
|---|---|
| Clinical decisions, protocols, delegation | The physician-owned entity |
| Premises, equipment, technology | The MSO |
| Marketing, branding, front office | The MSO |
| Billing operations | The MSO |
| Hiring and directing clinical staff | The physician-owned entity |
The last row is the one that gets blurred in practice, and it is the one a reviewer looks at.
The medical director is a defined obligation
Every Arkansas med spa offering medical services must appoint a licensed physician as designated medical director, legally responsible for supervising all practitioners and the medical procedures they perform.
“All practitioners and the procedures they perform” is broad. It is not a role that can be discharged by approving a protocol once and going away.
Delegation is available, with documentation
RNs and LPNs may inject under physician delegation and supervision. As everywhere, the delegation has to be documented, matched to the individual and the service, and kept current as the menu changes.
The question that actually decides your model
Ownership in Arkansas is settled and workable. What is not settled from public sources is the examination requirement — Arkansas is widely reported to require an in-person good faith examination before aesthetic treatment, with telehealth not satisfying it.
If that is right, it is a bigger constraint on an online-first model than the ownership rule, and it is the first thing we would confirm with the Arkansas State Medical Board.
